These Terms of Service ("Terms") govern your use of the Aristocrat Pet website at https://aristocratpet.com (the "Site") and any services provided by MCPLD LLC ("we," "us," or "our"), including the purchase of custom pet portrait wall art. By accessing the Site, placing an order, or otherwise using our services, you agree to these Terms in full. If you do not agree, please do not use the Site.

1. Eligibility & Agreement

By using the Site or submitting an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding agreement. These Terms form a legally binding contract between you and MCPLD LLC, a company registered in New Mexico, United States. Your use of the Site is also subject to our Privacy Policy and Return & Refund Policy, which are incorporated by reference. In the event of any conflict between these documents, these Terms shall take precedence.

2. Our Service

Aristocrat Pet provides a service that transforms pet photographs into custom wall art. When you place an order, you upload one or more photographs of your pet, select an artistic style and canvas size, and we produce a unique piece of artwork based on your selections. Each piece is made to order and personalized to your specifications.

3. Definitions

  • "Customer" refers to any person who places or attempts to place an order through the Site.
  • "Artwork" refers to the custom wall art portrait created from your uploaded pet photograph.
  • "Order" refers to a Customer's request to purchase Artwork through the Site.
  • "Uploaded Content" refers to any photographs, images, or other materials you submit through the Site for the purpose of creating your Artwork.

4. Placing an Order

When you submit an Order, you are making an offer to purchase custom Artwork subject to these Terms. All Orders are subject to acceptance at our discretion. We reserve the right to decline or cancel any Order for reasons including, but not limited to, pricing errors, suspected fraudulent activity, or if the uploaded photograph is unsuitable for artwork production (e.g., extremely low resolution, inappropriate content, or images that do not contain a pet).

If we cancel an Order after payment has been collected, we will issue a full refund to your original payment method.

5. Uploaded Content & Your Responsibilities

By uploading photographs to our Site, you represent and warrant that:

  • You own the photograph or have obtained all necessary permissions to use it.
  • The photograph does not infringe on any third party's intellectual property, privacy, or other rights.
  • The content does not contain anything unlawful, offensive, or inappropriate.

You grant MCPLD LLC a limited, non-exclusive license to use, process, and reproduce your uploaded photographs solely for the purpose of producing your custom Artwork and providing related customer support (such as reprints for damaged orders). We will not use your photographs for marketing, advertising, or any unrelated purpose without your explicit consent.

6. Pricing & Payment

All prices on the Site are listed in U.S. dollars and do not include applicable taxes or shipping fees unless stated otherwise. We may adjust pricing at any time, but changes will not affect Orders that have already been accepted.

Payment is required at the time of purchase using the payment methods available on the Site. By providing payment details, you confirm that you are authorized to use the selected payment method and agree to pay all charges associated with your Order.

7. Production & Delivery

Because each piece of Artwork is custom-produced, production times may vary. Estimated timelines are provided at checkout and are not guaranteed. We ship within the United States only. Once your Artwork is handed to the shipping carrier, risk of loss transfers to you.

Upon receiving your order, please inspect it promptly. If your Artwork arrives damaged, you must notify us within 48 hours of delivery by emailing hello@aristocratpet.com or through our Contact Page, including photographs of the damage.

8. Returns, Refunds & Cancellations

Due to the custom nature of our products, we do not accept returns or issue refunds for change of mind, incorrect size selection, or style preference. Refunds or replacements are available only for items that arrive damaged or defective, as detailed in our Return & Refund Policy.

Orders may be cancelled for a full refund only if production has not yet begun. Once your Artwork is in production, cancellations are no longer possible.

9. Intellectual Property

All content on the Site — including text, graphics, logos, page designs, and artistic style templates — is the property of MCPLD LLC and is protected by U.S. and international intellectual property laws.

Regarding the custom Artwork we create for you: upon full payment and delivery, you receive a personal, non-commercial license to display and enjoy your Artwork. MCPLD LLC retains all underlying intellectual property rights in the artistic styles, techniques, and processes used to create the Artwork. You may not reproduce, resell, or commercially distribute the Artwork without our written permission.

You may not copy, modify, distribute, or create derivative works from any content on the Site without prior written consent from MCPLD LLC.

10. Account Security

If you create an account on our Site, you are responsible for providing accurate information and keeping your login credentials secure. You are liable for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at hello@aristocratpet.com. We are not responsible for losses resulting from compromised account credentials.

11. Prohibited Conduct

When using the Site, you agree not to:

  • Violate any applicable law or regulation
  • Upload content that is unlawful, offensive, infringing, or harmful
  • Transmit malicious software, viruses, or any code designed to disrupt the Site
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • Use bots, scrapers, or other automated tools to extract data from the Site without permission
  • Misrepresent your identity or impersonate another person

12. Third-Party Services

The Site may link to or integrate with third-party services, including payment gateways, shipping carriers, and social media platforms. These services operate under their own terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party service.

13. Disclaimers

THE SITE, ARTWORK, AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL OPERATE WITHOUT INTERRUPTION OR ERROR, OR THAT IT WILL BE FREE FROM HARMFUL COMPONENTS.

WHILE WE STRIVE TO PRODUCE HIGH-QUALITY ARTWORK THAT ACCURATELY REFLECTS YOUR PET, ARTISTIC INTERPRETATION IS INHERENT IN OUR PROCESS. MINOR VARIATIONS BETWEEN THE UPLOADED PHOTOGRAPH AND THE FINAL ARTWORK ARE EXPECTED AND DO NOT CONSTITUTE A DEFECT.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MCPLD LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, DATA LOSS, OR GOODWILL — ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF ARTWORK, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless MCPLD LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or violation of any third party's rights — including claims arising from Uploaded Content that you did not have the right to use.

16. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or if your conduct may harm us, other users, or third parties. Upon termination, your right to use the Site ceases immediately. Provisions that are intended to survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain in effect.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in New Mexico. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

18. Modifications

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting to the Site with a revised effective date. Continued use of the Site after modifications are posted constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.
